Haulers & Service Providers
Pickups are performed by third-party haulers operating as independent contractors. Haulers are not employees, agents, or partners of Dropcurb. Dropcurb facilitates booking, payment, and support, but does not perform pickups directly. Dropcurb is not liable for the negligence or acts of independent haulers beyond the limits set out below.
Items Staged at the Curb
Items staged at the curb are publicly accessible. Dropcurb and haulers are not responsible for items removed, damaged, stolen, or weather-affected between the time of staging and the time of pickup. We recommend staging items on the morning of your pickup date. Dropcurb and haulers are not liable for items you intended to keep that were inadvertently staged at the curb with items for pickup.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DROPCURB'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID FOR THE SERVICE GIVING RISE TO THE CLAIM. DROPCURB IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF USE OR PROPERTY VALUE, EVEN IF ADVISED OF THE POSSIBILITY.
This limitation does not apply to liability that cannot be excluded under applicable law, including liability for gross negligence or willful misconduct.
Indemnification
You agree to indemnify and hold harmless Dropcurb and its haulers from claims, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your breach of these terms; (b) your violation of law; (c) staging of prohibited items; or (d) misrepresentation of items or volume at booking.
Cancellation & Refunds
Cancellation and refund terms are set out in our Refund Policy.
Force Majeure
Dropcurb is not liable for failure or delay in performance caused by events outside reasonable control, including weather, natural disasters, carrier outages, public health emergencies, or government action.
Termination
Dropcurb may refuse or cancel service at its discretion, including when items staged at the curb include prohibited materials or present a safety risk. Indemnity and limitation-of-liability provisions survive termination.
Governing Law
These terms are governed by the laws of the State of Wyoming, without regard to conflict-of-laws principles. Disputes not resolved informally will be brought in the state or federal courts of Wyoming, and you consent to personal jurisdiction and venue in those courts.
Severability & Entire Agreement
If any provision of these terms is held unenforceable, the remaining provisions remain in effect. These terms, together with the Privacy Policy, SMS Consent, and Refund Policy, constitute the entire agreement between you and Dropcurb regarding the service.
Changes to Terms
We may update these terms from time to time. Material changes will be posted with a new "last updated" date. Continued use of Dropcurb after changes constitutes acceptance.
